Does HHC legality have an expiration date?

The cannabis market is specific in many ways. It is growing at almost rocket speed and is expected to reach an annual turnover of 25 billion dollars by 2025 in the US alone. There is a rapidly growing number of users who see great potential in cannabis products. And roughly one in four use more than one cannabis product (oils, topicals, candies, etc.). The number of producers and sellers is growing and the cannabis product range is expanding. One of the most enticing innovations in recent months is the semi-synthetic cannabinoid HHC. Hexahydrocannabinol benefits mainly from its similarity to THC. It is a psychoactive compound that is very similar in chemical structure to THC, except for the absence of double bonds. Its effects are also very similar. However, they are said to be less intense.

Effects of HHC (only anecdotal evidence from user reviews or animal tests):

- Pain relief
- Sleep support
- Higher heart rate
- Stress relief
- Burst of energy
- A brighter mind

All effects are individual and depend on the sensitivity of the user. This is true of all cannabinoids. Although HHC is very popular among people, there have been no studies that have identified it as safe or risky. It's all up to you to decide and carefully observe the effects of HHC on the human body.

HHC (like any other cannabinoid) affects each person differently. It is necessary to observe even the slightest manifestations and deviations from normal and mild side effects.


Legal. For now

The effects of HHC are interesting, but a little more appealing is the fact that hexahydrocannabinol is legal. Unlike THC, which is still banned in most of the world. Its use is only possible in selected products such as full-spectrum oil. This may contain tetrahydrocannabinol in quantities that do not produce psychoactive effects (normally between 0.2 and 0.3%, in the Czech Republic the limit is set at 1% from January 2022), but may contribute to the overall effect - synergistically supporting the action of other cannabinoids (e.g. CBD).

HHC is currently (October 2022) legal in the Czech Republic. This is confirmed by information from the Ministry of Health website. It is there that any changes will first be seen. To be absolutely sure that you are not going beyond the law by using HHC, it is advisable to keep checking the current information.

The substance Hexahydrocannabinol (HHC, C21H32O2) is not currently on the list of addictive substances of Government Regulation No. 463/2013 Coll., on lists of addictive substances, as amended, and is not subject to Act No. 167/1998 Coll., on addictive substances and on amendments to certain other acts, as amended.

A draft amendment to Government Regulation No. 463/2013 Coll., on lists of addictive substances, as amended, is currently in the legislative process. The listed substance HHC is not in the draft of this amendment.

However, this does not mean that the status of HHC is unchanged. It is a psychoactive substance similar to THC with the ability to alter consciousness and affect cognitive and sensorimotor functions, so its position is at least uncertain. There is also the possibility that the law will go the other way and THC will be partially legalised. However, these are only possible alternatives and it is not possible to predict what might happen.

Although HHC occurs naturally in the cannabis plant, it contains only trace amounts and is therefore produced in the laboratory. Originally, HHC was extracted from THC. This was first done by the hydrogenation method, when American chemist Roger Adams added hydrogen molecules to delta-9 THC to produce hexahydrocannabinol from tetrahydrocannabinol. Today, however, other methods are used to produce HHC, most commonly extraction from CBD, which is abundant in industrial hemp.

The risk is mainly related to the quality of HHC. Human research is lacking and hexahydrocannabinol, like most cannabinoids (except THC, which is illegal), is not subject to regulation regarding testing for 'product purity', possible contamination with toxic substances and potency.

Summary

HHC is legal and there are no penalties for its production, distribution or use.  However, it cannot be relied upon and conditions can change (tighten) quite quickly. It is advisable to keep the position of the Ministry of Health under review.
